Terms of Use

These terms are an agreement between you and 3DMOCKUPS LLC ("we", "us") for the CutSell app and the website cutsell.app (together, "CutSell"). By using CutSell you accept them. They supplement Apple's Standard License Agreement for apps (EULA); where the two conflict about the app, these terms apply to the extent Apple allows.

1. Who can use CutSell

You must be at least 18, or the age of majority where you live, and able to enter into this agreement. If you use CutSell for a business, you accept these terms on its behalf.

2. The license

We give you a personal, non-exclusive, non-transferable, revocable license to use CutSell on Apple devices you own or control, under these terms and Apple's usage rules. You may not copy, resell, reverse-engineer, or misuse the app or its servers (for example by automating requests, getting around limits or credits, or interfering with the service).

3. Your content

Your recordings, photos, scripts and finished videos are yours. When you use a feature that needs our server or an AI provider, you give us a limited license to process that content only to provide the feature to you, as described in the Privacy Policy.

You promise that you have the rights to the content you use, including the permission of every person who appears in it. For the AI video tools, only use photos, videos and voices of people who have agreed to it. Do not use CutSell to impersonate anyone, to mislead viewers about who is speaking, or to create sexual, hateful, violent, deceptive or illegal content, or content that infringes someone else's rights.

4. AI features

AI edits, scripts, captions and generated videos are produced automatically and can contain mistakes: wrong cuts, wrong words, changed details or products that look different from the real one. Review everything before you post it. You are responsible for what you publish.

CutSell helps you edit; it does not review your videos for any platform's rules. It does not tell you that a video is allowed, approved or guaranteed to perform. Following TikTok Shop's and any other platform's rules, product claims and disclosure requirements (such as marking paid or affiliate content) is your responsibility.

5. TikTok

CutSell is independent and is not affiliated with, endorsed or sponsored by TikTok or ByteDance. CutSell does not access your TikTok account or post for you.

6. Subscriptions

  • Plans. CutSell Plus, Pro and Max include a monthly number of AI edits (100, 300 and unlimited, respectively) and a monthly allowance of credits for the AI video tools, as shown in the app at the time of purchase.
  • Billing and renewal. Subscriptions bought in the app are sold by Apple and billed to your Apple Account. They renew automatically at the end of each period (monthly or yearly) at the then-current price unless you turn off auto-renew at least 24 hours before the period ends. Manage or cancel in your iPhone's Settings → your name → Subscriptions.
  • Free trial. Where a free trial is offered, it converts to a paid subscription when it ends unless you cancel at least 24 hours before. Any unused part of a trial is forfeited when you buy a subscription.
  • Refunds for subscriptions bought in the app are handled by Apple under its policies; we cannot issue them directly. Subscriptions bought on cutsell.app follow section 6b instead.
  • Fair use: heavy use may take longer. AI edits run on shared capacity. On every plan, when you use them heavily, new AI edits may take longer: they can wait in a queue and continue later the same day or the next day, and they may be handled by a lighter AI model. They are not refused for that reason, and the app shows when one is waiting. Max has no monthly limit on AI edits; it is for one creator's own normal use, and accounts that appear automated or shared may be limited.
  • Changes. We may change plans or prices for future periods. Apple will notify you of price increases as its rules require.

6a. Waitlist offer

People who join the waitlist on cutsell.app before launch receive, by email on launch day, a code for 50% off the first year of a yearly CutSell plan (Plus, Pro or Max). The code is redeemed through the App Store, is for new subscribers (or those whose subscription has expired), may be used once per Apple Account, cannot be combined with the free trial, and expires on the date stated in the email. After the discounted year the plan renews at the regular yearly price unless you cancel. Prices outside the United States follow the App Store's price for your country. We may end the waitlist offer for new sign-ups at any time; codes already promised will be honored.

6b. Founding member pre-order (cutsell.app)

On cutsell.app/start we sell a founding member pre-order: the first year of a yearly CutSell plan at 50% off, bought on the web before the app is available on the App Store. These terms apply to it in addition to section 6, and win where the two differ.

  • What you pay, and when. The full first year is charged when you buy: Plus US$71.99, Pro US$179.99 or Max US$319.99, plus any sales tax that applies where you live (shown at checkout).
  • It renews automatically. This is an auto-renewing yearly subscription. After the first year it renews every year at the regular yearly price, today Plus US$143.99, Pro US$359.99 or Max US$639.99, charged to the same payment method, unless you cancel before the renewal date. We email you a reminder before each yearly renewal, with the date, the price and how to cancel.
  • Cancel anytime, online. Use the "manage your subscription" link in your purchase email (it opens the customer portal) or write to support@cutsell.app. Cancelling stops the next renewal; you keep access until the end of the year you paid for. You never need to call anyone to cancel.
  • The app is not out yet. CutSell is in Apple's review when you buy. Your plan is delivered inside the CutSell iPhone app once Apple makes it available: we email the address you used at checkout, and you activate the plan on your iPhone with a one-time activation link (a "redemption link"). Links expire after 60 minutes; opening an expired one in the app sends a fresh one to the same email.
  • Your 12 months start at launch. We add the days between your purchase and the day CutSell is available on the App Store to your subscription, so you get a full year of use. Your renewal date moves by the same number of days.
  • Refunds. Before launch, you can ask for a full refund at any time, for any reason, at support@cutsell.app. If CutSell is not available on the App Store by December 31, 2026, we refund every founding member in full automatically, without you having to ask. After launch, you can ask for a full refund within 14 days of the launch date if you have not activated the plan in the app; otherwise payments are not refundable for partial periods, except where the law requires it. Refunds go back to the original payment method and can take a few business days to appear.
  • What the plan includes. The same Plus, Pro or Max plan sold in the app (section 6), including fair use. Yearly plans include the year's credits at once (section 7).
  • Who processes the payment. Web purchases are handled by RevenueCat (checkout, subscription management, receipts and subscription emails, activation links), with Stripe as the payment processor (card, Apple Pay, Google Pay). We never see your full card number.
  • Separate from the App Store. A web subscription is not an App Store subscription: it is not managed in your iPhone's Settings, Apple does not bill or refund it, and "Restore Purchases" in the app does not bring it back on its own (use the activation link). If you also subscribe in the app, you will be billed twice; cancel one.
  • United States. The pre-order is offered in U.S. dollars. It is one per person, for your own use, and cannot be resold or transferred.
  • No guaranteed date. We cannot control when Apple approves the app. If we cannot launch, the refund above is your remedy.

By completing checkout you confirm you have read these terms, agree that the subscription renews automatically as described above until you cancel, and authorize the yearly charges to your payment method.

7. Credits

  • Credits are a license to use the AI video tools inside CutSell. They have no cash value, cannot be transferred or exchanged for money, and are not a stored-value product.
  • The cost of each job in credits is shown before you start. If a job fails, its credits are returned automatically. Exporting never uses credits.
  • Credits you buy and credits included with a plan are tied to the device key that bought them, as described in the Privacy Policy. Because CutSell has no accounts, credits may not be recoverable if that key is lost, for example on a new device; subscriptions can be restored with "Restore Purchases".
  • Free credits (such as welcome credits) are promotional and may change.

8. Availability and changes

We work to keep CutSell available but do not promise it will be uninterrupted or error-free. Features that depend on AI providers can have daily limits, may be slower at busy times, and may change or be discontinued. Rendering happens on your iPhone while the app is open. We may update or change CutSell at any time.

9. Ending your use

You can stop using CutSell at any time by deleting the app and cancelling any subscription (in the App Store, or from the customer portal for one bought on cutsell.app). We may suspend or end your access if you break these terms or misuse the service. Sections 3, 4, 7 and 10–13 survive.

10. Disclaimer

CutSell is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise any level of views, sales or commissions.

11. Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or content. Our total liability for any claim relating to CutSell is limited to the amount you paid for CutSell in the 12 months before the claim. Some places do not allow these limits, so they may not fully apply to you.

12. Indemnity

You agree to defend and hold us harmless from claims arising from your content, what you publish, or your breach of these terms.

13. Governing law

These terms are governed by the laws of the United States and of the state in which 3DMOCKUPS LLC is organized, without regard to conflict-of-law rules. If you are a consumer in a country with mandatory consumer protections, nothing here takes those away.

14. Apple

These terms are between you and us, not Apple. Apple is not responsible for CutSell or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app (including product liability, legal compliance or intellectual-property claims). If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You confirm you are not in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

15. Changes to these terms

We may update these terms. We will change the date above and, for significant changes, tell you in the app. Continuing to use CutSell after that means you accept the new terms.

Estos términos son un acuerdo entre tú y 3DMOCKUPS LLC ("nosotros") sobre la app CutSell y el sitio cutsell.app (juntos, "CutSell"). Al usar CutSell los aceptas. Complementan el Contrato de licencia estándar de Apple para apps (EULA); si ambos se contradicen respecto a la app, se aplican estos términos en la medida en que Apple lo permita.

1. Quién puede usar CutSell

Debes tener al menos 18 años, o la mayoría de edad de tu país, y capacidad para aceptar este acuerdo. Si usas CutSell para un negocio, aceptas estos términos en su nombre.

2. La licencia

Te damos una licencia personal, no exclusiva, intransferible y revocable para usar CutSell en dispositivos Apple que tengas o controles, según estos términos y las reglas de uso de Apple. No puedes copiar, revender, hacer ingeniería inversa ni hacer mal uso de la app o de sus servidores (por ejemplo, automatizando solicitudes, evitando límites o créditos, o interfiriendo con el servicio).

3. Tu contenido

Tus grabaciones, fotos, guiones y videos terminados son tuyos. Cuando usas una función que necesita nuestro servidor o un proveedor de IA, nos das una licencia limitada para procesar ese contenido solo para darte la función, como se describe en la Política de privacidad.

Garantizas que tienes los derechos sobre el contenido que usas, incluido el permiso de cada persona que aparece en él. En las herramientas de video con IA, usa solo fotos, videos y voces de personas que lo hayan aceptado. No uses CutSell para suplantar a nadie, engañar al público sobre quién habla, ni crear contenido sexual, de odio, violento, engañoso o ilegal, o que infrinja derechos de otros.

4. Funciones de IA

Las ediciones, guiones, subtítulos y videos generados con IA se producen de forma automática y pueden tener errores: cortes o palabras equivocadas, detalles cambiados o productos que se ven distintos al real. Revisa todo antes de publicarlo. Eres responsable de lo que publicas.

CutSell te ayuda a editar; no revisa tus videos según las normas de ninguna plataforma. No te dice que un video esté permitido, aprobado ni garantizado. Cumplir las normas de TikTok Shop y de cualquier otra plataforma, lo que afirmas sobre los productos y los avisos obligatorios (como señalar contenido pagado o de afiliado) es tu responsabilidad.

5. TikTok

CutSell es independiente y no está afiliada, respaldada ni patrocinada por TikTok ni por ByteDance. CutSell no accede a tu cuenta de TikTok ni publica por ti.

6. Suscripciones

  • Planes. CutSell Plus, Pro y Max incluyen un número mensual de ediciones con IA (100, 300 e ilimitadas, respectivamente) y una cantidad mensual de créditos para las herramientas de video con IA, según se muestra en la app al momento de la compra.
  • Cobro y renovación. Las suscripciones que compras en la app las vende Apple y se cobran a tu Cuenta de Apple. Se renuevan solas al final de cada periodo (mensual o anual) al precio vigente, salvo que desactives la renovación al menos 24 horas antes de que termine el periodo. Gestiónalas o cancélalas en Ajustes de tu iPhone → tu nombre → Suscripciones.
  • Prueba gratis. Cuando se ofrece una prueba gratis, al terminar pasa a ser una suscripción de pago salvo que la canceles al menos 24 horas antes. La parte no usada de la prueba se pierde al comprar una suscripción.
  • Los reembolsos de las suscripciones compradas en la app los gestiona Apple según sus políticas; nosotros no podemos darlos directamente. Las suscripciones compradas en cutsell.app siguen la sección 6b.
  • Uso razonable: con un uso intenso, puede tardar más. Las ediciones con IA usan una capacidad compartida. En todos los planes, cuando las usas de forma intensa, las nuevas ediciones con IA pueden tardar más: pueden esperar en una cola y seguir más tarde ese mismo día o al día siguiente, y pueden hacerse con un modelo de IA más ligero. No se rechazan por eso, y la app muestra cuando una está en espera. Max no tiene un límite mensual de ediciones con IA; es para el uso normal de un creador, y podemos limitar las cuentas que parezcan automatizadas o compartidas.
  • Cambios. Podemos cambiar planes o precios para periodos futuros. Apple te avisará de los aumentos de precio según sus reglas.

6a. Oferta de la lista de espera

Quienes se unan a la lista de espera en cutsell.app antes del lanzamiento reciben por correo, el día del lanzamiento, un código con 50% de descuento en el primer año de un plan anual de CutSell (Plus, Pro o Max). El código se canjea en el App Store, es para nuevos suscriptores (o cuya suscripción haya vencido), se puede usar una vez por Cuenta de Apple, no se combina con la prueba gratis y vence en la fecha indicada en el correo. Después del año con descuento, el plan se renueva al precio anual normal salvo que canceles. Fuera de Estados Unidos, los precios siguen el precio del App Store de tu país. Podemos terminar la oferta para nuevos registros en cualquier momento; los códigos ya prometidos se respetarán.

6b. Preventa de miembro fundador (cutsell.app)

En cutsell.app/start vendemos una preventa de miembro fundador: el primer año de un plan anual de CutSell con 50% de descuento, comprado en la web antes de que la app esté en el App Store. Estos términos se suman a la sección 6 y prevalecen donde las dos difieran.

  • Cuánto pagas y cuándo. El primer año completo se cobra al comprar: Plus US$71.99, Pro US$179.99 o Max US$319.99, más el impuesto sobre las ventas que corresponda donde vives (se muestra al pagar).
  • Se renueva sola. Es una suscripción anual de renovación automática. Después del primer año se renueva cada año al precio anual normal, hoy Plus US$143.99, Pro US$359.99 o Max US$639.99, con el mismo medio de pago, salvo que la canceles antes de la fecha de renovación. Antes de cada renovación anual te mandamos un recordatorio por correo con la fecha, el precio y cómo cancelar.
  • Cancela cuando quieras, en línea. Usa el enlace "gestionar tu suscripción" del correo de compra (abre el portal del cliente) o escríbenos a support@cutsell.app. Al cancelar se detiene la próxima renovación y conservas el acceso hasta el final del año que pagaste. Nunca tienes que llamar a nadie para cancelar.
  • La app todavía no ha salido. Cuando compras, CutSell está en revisión de Apple. Tu plan se entrega dentro de la app de CutSell para iPhone en cuanto Apple la publique: te escribimos al correo que usaste al pagar y activas el plan en tu iPhone con un enlace de activación de un solo uso (un "enlace de canje"). Los enlaces caducan a los 60 minutos; si abres uno caducado en la app, te llega uno nuevo al mismo correo.
  • Tus 12 meses empiezan con el lanzamiento. Sumamos a tu suscripción los días que pasen entre tu compra y el día en que CutSell esté en el App Store, para que tengas un año completo de uso. Tu fecha de renovación se corre esos mismos días.
  • Reembolsos. Antes del lanzamiento puedes pedir el reembolso completo en cualquier momento y por cualquier motivo en support@cutsell.app. Si CutSell no está disponible en el App Store a más tardar el 31 de diciembre de 2026, le devolvemos todo a cada miembro fundador de forma automática, sin que tenga que pedirlo. Después del lanzamiento, puedes pedir el reembolso completo dentro de los 14 días siguientes a la fecha de lanzamiento si todavía no activaste el plan en la app; fuera de eso, los pagos no se reembolsan por periodos parciales, salvo donde la ley lo exija. El reembolso vuelve al medio de pago original y puede tardar unos días hábiles en aparecer.
  • Qué incluye el plan. El mismo plan Plus, Pro o Max que se vende en la app (sección 6), con su uso razonable. Los planes anuales incluyen los créditos del año de una vez (sección 7).
  • Quién procesa el pago. Las compras en la web las gestiona RevenueCat (el pago, la gestión de la suscripción, los recibos y correos de la suscripción, y los enlaces de activación), con Stripe como procesador de pagos (tarjeta, Apple Pay, Google Pay). Nunca vemos el número completo de tu tarjeta.
  • Aparte del App Store. Una suscripción web no es una suscripción del App Store: no se gestiona en los Ajustes de tu iPhone, Apple no la cobra ni la reembolsa, y "Restaurar compras" en la app no la recupera por sí sola (usa el enlace de activación). Si además te suscribes en la app, se te cobrará dos veces; cancela una.
  • Estados Unidos. La preventa se ofrece en dólares estadounidenses. Es una por persona, para tu propio uso, y no se puede revender ni transferir.
  • Sin fecha garantizada. No controlamos cuándo aprueba Apple la app. Si no podemos lanzar, el reembolso de arriba es tu solución.

Al completar el pago confirmas que leíste estos términos, aceptas que la suscripción se renueve sola como se describe arriba hasta que la canceles y autorizas los cobros anuales a tu medio de pago.

7. Créditos

  • Los créditos son una licencia para usar las herramientas de video con IA dentro de CutSell. No tienen valor en dinero, no se pueden transferir ni cambiar por dinero, y no son un producto de valor almacenado.
  • El costo de cada trabajo en créditos se muestra antes de empezar. Si un trabajo falla, sus créditos vuelven solos. Exportar nunca usa créditos.
  • Los créditos que compras y los incluidos en un plan están ligados a la clave del dispositivo que los compró, como se describe en la Política de privacidad. Como CutSell no tiene cuentas, puede que no se recuperen si esa clave se pierde, por ejemplo en un teléfono nuevo; las suscripciones se recuperan con "Restaurar compras".
  • Los créditos gratis (como los de bienvenida) son promocionales y pueden cambiar.

8. Disponibilidad y cambios

Trabajamos para que CutSell esté disponible, pero no prometemos que funcione sin interrupciones ni errores. Las funciones que dependen de proveedores de IA pueden tener límites diarios, ir más lentas en horas de mucha demanda, y cambiar o dejar de estar disponibles. El renderizado ocurre en tu iPhone con la app abierta. Podemos actualizar o cambiar CutSell en cualquier momento.

9. Fin del uso

Puedes dejar de usar CutSell cuando quieras borrando la app y cancelando cualquier suscripción (en el App Store o, si la compraste en cutsell.app, desde el portal del cliente). Podemos suspender o terminar tu acceso si incumples estos términos o haces mal uso del servicio. Las secciones 3, 4, 7 y 10 a 13 siguen vigentes.

10. Exención de garantías

CutSell se ofrece "tal cual" y "según disponibilidad". En la máxima medida que permita la ley, no damos garantías, expresas ni implícitas, incluidas las de comerciabilidad, idoneidad para un fin concreto y no infracción. No prometemos ningún nivel de vistas, ventas ni comisiones.

11. Limitación de responsabilidad

En la máxima medida que permita la ley, no respondemos por daños indirectos, incidentales, especiales, consecuentes o punitivos, ni por pérdida de ganancias, ingresos, datos o contenido. Nuestra responsabilidad total por cualquier reclamo relacionado con CutSell se limita a lo que pagaste por CutSell en los 12 meses anteriores al reclamo. Algunos lugares no permiten estos límites, así que pueden no aplicarse del todo a ti.

12. Indemnidad

Aceptas defendernos y mantenernos indemnes frente a reclamos que surjan de tu contenido, de lo que publicas o de tu incumplimiento de estos términos.

13. Ley aplicable

Estos términos se rigen por las leyes de Estados Unidos y del estado en que está constituida 3DMOCKUPS LLC, sin considerar sus normas de conflicto de leyes. Si eres consumidor en un país con protecciones obligatorias, nada de esto te las quita.

14. Apple

Estos términos son entre tú y nosotros, no con Apple. Apple no es responsable de CutSell ni de su contenido, no está obligada a dar mantenimiento ni soporte, y no responde por reclamos relacionados con la app (incluidos los de responsabilidad por producto, cumplimiento legal o propiedad intelectual). Si la app no cumple alguna garantía aplicable, puedes avisar a Apple para que te reembolse el precio de compra, si lo hubo; Apple no tiene ninguna otra obligación de garantía. Apple y sus filiales son terceros beneficiarios de estos términos y pueden hacerlos valer. Confirmas que no estás en un país sujeto a embargo del Gobierno de EE. UU. ni en ninguna lista de personas prohibidas o restringidas del Gobierno de EE. UU.

15. Cambios en estos términos

Podemos actualizar estos términos. Cambiaremos la fecha de arriba y, si el cambio es importante, te avisaremos en la app. Seguir usando CutSell después significa que aceptas los nuevos términos.
